Terms of sale

These terms and conditions of sale are entered into, on the one hand, by SAS J2MN, with a share capital of €10,000, whose registered office is located at 2 rue de la Désirée, 17000 La Rochelle, registered with the Paris Trade and Companies Register under number 81442846200026 – contact@pieddebiche-paris.com – +33 (0)7 81 34 70 71, hereinafter referred to as Pied de Biche – Paris, and, on the other hand, by any natural or legal person wishing to make a purchase via the Pied de Biche website, hereinafter referred to as the buyer.

Article 1. Purpose

These terms and conditions of sale are intended to define the contractual relationship between Pied de Biche – Paris and the buyer, as well as the conditions applicable to any purchase made through the Pied de Biche – Paris online store, whether the buyer is a professional or a consumer.
The acquisition of a product or service through this website implies the buyer’s full and unconditional acceptance of these terms and conditions of sale.
These terms and conditions shall prevail over any other general or specific conditions not expressly approved by Pied de Biche – Paris.
Pied de Biche – Paris reserves the right to modify its terms and conditions of sale at any time. In such case, the applicable conditions shall be those in force on the date of the buyer’s order.

Article 2. Characteristics of the products and services offered

The products and services offered are those listed in the catalogue published on the Pied de Biche – Paris website.
These products and services are offered subject to availability.
Each product is accompanied by a description provided by the supplier; for some products, the buyer may have access to the supplier’s documentation.
The photographs in the catalogue are as accurate as possible but cannot guarantee perfect similarity with the product offered, particularly with regard to colors.

Article 3. Prices

The prices shown in the catalogue are prices including VAT, expressed in euros, taking into account the VAT applicable on the date of the order; any change in the VAT rate may be reflected in the price of the products or services.
Pied de Biche reserves the right to modify its prices at any time, it being understood that the price appearing in the catalogue on the day of the order shall be the only one applicable to the buyer.
The prices indicated include order processing costs but do not include transport and delivery costs.

Article 4. Geographical area

Pied de Biche – Paris delivers its products worldwide. The delivery and returns policy is detailed in the corresponding section. Shipping costs include a contribution to preparation and packaging costs as well as postage costs. The amount of these costs is indicated in the “cart” section and is subject to the buyer’s approval before each order is validated.
For shipments outside Europe, any customs duties remain the responsibility of the buyer.

Article 5. Orders

The buyer wishing to purchase a product or service must obligatorily:
– complete the registration form, providing all required contact details;
– validate the order after reviewing it;
– make payment under the conditions provided;
– confirm the order and payment.

Order confirmation constitutes acceptance of these terms and conditions of sale, acknowledgment of full knowledge thereof, and waiver of the buyer’s own purchasing conditions or any other conditions.
All data provided and the recorded confirmation shall constitute proof of the transaction. Confirmation shall constitute signature and acceptance of the transactions carried out.
The seller will send confirmation of the recorded order by email.

Article 6. Exchange / Refund

EXCHANGE

Buyers who are natural persons acting as non-professionals benefit from a 15-day exchange period from receipt of their order. If the 15-day period between receipt of the parcel and the exchange request is respected, return shipping costs are borne by the seller.
Each order is eligible for one free return only. Returned items must be in new condition, accompanied by all accessories (sole protectors, etc.). A pair of shoes whose temporary sole protectors have not been returned or have been fitted cannot be considered new.
An exchange may only be made for a model of the same price, and cannot give rise to a partial refund if the price of the model has changed since the initial order.
In the event of a partial refund request for an order that benefited from a tiered discount on the total cart, the credited amount will be calculated solely based on the discount percentage applied to the item(s) retained. A gift box being a single item, no return of a single component will be accepted. In the event of a refund request for an item contained in a gift box, the credited amount will be calculated solely based on the original price of the item(s) retained.

An exchange request must be made via the customer account using the Returns module.

REFUND

Buyers who are natural persons acting as non-professionals benefit from a 15-day refund request period from receipt of their order, in accordance with the consumer’s right of withdrawal.

Following an accepted return request submitted on the website, buyers have 14 days to return their order to the logistics center (Article L221-24 of the French Consumer Code).
The refund will be processed within 14 days maximum after receipt of the order by our logistics center, to the credit card or PayPal account used for the purchase.

In the event of the return of all or part of an order paid in whole or in part with an Illicado card, the refund will be made to the same gift card, which will automatically be recredited with the amount of the returned item, up to the amount initially paid using this payment method. Customers are required to keep their Illicado card (physical or digital) during the possible return period. If the validity period of the gift card has expired at the time of the refund, the refund will be issued in the form of a store credit / voucher with Pied de Biche.
In the event of a refund, please ensure that the bank card used for the order is still valid. Otherwise, please send your bank details (RIB) to contact@pieddebiche-paris.com.

In the event of the return of all or part of an order paid in whole or in part with a Pied de Biche gift card, the refund will be made to the same gift card, which will automatically be reactivated and recredited with the amount of the returned item, up to the amount initially paid using this payment method. If the gift card has expired at the time of the refund, a new voucher valid for 3 months (non-renewable) will be issued.

A refund request must be made via the customer account using the Returns module.

RETURNS

Returns are free for all orders delivered within the European Union.

For orders delivered outside the European Union, return shipping costs are the customer’s responsibility and may vary depending on the country of delivery.

Return policies are detailed in the “Returns” section of the website.

CUSTOMS DUTIES

For orders delivered to the United States, the United Kingdom and Switzerland, customs duties and taxes are included in the sale price and will not be charged additionally upon delivery.

For orders delivered to other countries subject to customs duties, these may be refunded upon presentation of proof of payment, provided that the customer keeps at least one pair of shoes from the order.

If the entire order is returned, customs duties and taxes will remain the responsibility of the customer.

Article 7. Payment terms

Payment is due upon ordering. Payments are made by credit card via the secure Hipay system, which uses SSL (Secure Socket Layer) encryption so that transmitted information is encrypted and cannot be intercepted by third parties during transmission.
The buyer’s account will be debited after order validation.
An invoice showing VAT is available at any time in the buyer’s account or upon simple request.

Article 8. Delivery

Deliveries are made to the address provided in the order, which must be within the agreed geographical area.
Deliveries are carried out by Colissimo, Chronopost, DHL, or Mondial Relay, from Monday to Saturday.
Colissimo deliveries are made without signature; Chronopost and DHL deliveries require signature.
If Mondial Relay delivery is selected, the parcel will be available at the pickup point for 5 days.

Delivery times depend on the option chosen by the customer at checkout; if delivery exceeds 30 days from the order date, the sales contract may be canceled and the buyer refunded. To ensure delivery times are met, customers must ensure the accuracy of the information provided. Pied de Biche delivers within 12 business days in mainland France and 20 business days internationally. These times may be extended in the case of pre-orders.

Customers must ensure receipt of their parcel using the tracking number available in their customer account. Any delivery claim must be made within 10 days; no action can be taken beyond this period, as the parcel will be considered delivered.

Return or exchange policy: returned items must be in new condition, accompanied by all accessories (sole protectors, etc.). A pair of shoes whose temporary sole protectors have not been returned or have been fitted cannot be considered new.

Any order benefiting from Click & Collect must be collected in-store within 15 calendar days from notification of availability. Failure to collect within this period will result in automatic cancellation and refund according to the original payment method.

You may exchange your item for an identical item or request a refund. Exchanges are only possible for the same model (size change only) and cannot give rise to a partial refund if the price has changed since the initial order. Partial refunds for orders benefiting from tiered discounts will be calculated solely based on the discount percentage applied to the retained item(s). For items contained in a gift box, refunds are calculated solely based on the original price of the retained item(s).
Please contact contact@pieddebiche-paris.com for instructions. Refunds are processed within 14 days maximum after receipt of the withdrawal request, to the original payment method. However, the refund may be deferred until the returned item is received (Article L221-24 of the French Consumer Code).

Article 9. Warranty

All products supplied by the seller benefit from the legal warranty provided for in Articles 1641 et seq. of the French Civil Code.
In the event of non-conformity, the product may be returned, exchanged, or refunded.
All claims must be made within 30 days of delivery.

All items undergo quality testing. You have 1 year after receipt to notify us of any manufacturing defect. The warranty does not cover damage caused by misuse or negligence.

Limitation of liability

The liability of SAS J2MN for any product purchased on the website is strictly limited to the purchase price of the product. SAS J2MN shall not be liable for the following losses, regardless of their origin:

  • loss of revenue or sales

  • loss of business

  • loss of profits or contracts

  • loss of anticipated savings

  • loss of data

  • loss of working or management time

  • damage to brand image

  • loss of opportunity, including the inability to order a product

  • moral damage

Product descriptions and information on the website are not covered by any express or implied warranty, except as provided by law.

SAS J2MN provides no guarantee against damage caused by computer viruses, worms, Trojan horses, logic bombs, or other malicious software. Customers are responsible for installing appropriate antivirus and security software.

Article 10. Liability

The seller is bound only by an obligation of means in the online sales process and shall not be held liable for damage resulting from Internet use such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

Article 11. Intellectual property

All elements of the Pied de Biche – Paris website are and remain the exclusive intellectual property of Pied de Biche – Paris.
No one is authorized to reproduce, exploit, redistribute, or use any elements of the website, whether material, software, visual, or audio, even partially.

Article 12. Personal data

In accordance with the French Data Protection Act of January 6, 1978, personal data relating to buyers may be subject to automated processing.
Pied de Biche – Paris reserves the right to collect buyer information, including through cookies, and to transmit such information to commercial partners.
Buyers may object to disclosure of their details and have rights of access and rectification. Customers may also register on a telephone marketing opt-out list.
This processing was declared to the CNIL on November 10, 2015, under number 1903848V0.

Article 13. Archiving – Evidence

Pied de Biche – Paris will archive invoices on a reliable and durable medium constituting a faithful copy in accordance with Article 1348 of the French Civil Code.
Computerized records shall be considered proof of communications, orders, payments, and transactions.

Article 14. Dispute resolution

These online terms and conditions are governed by French law.
In the event of a dispute, jurisdiction is granted to the competent courts.
